This Terms of Use Agreement (the "Terms") applies to your access and use of all applications under Future AI Magic Limited. By accessing and/or using the applications and services under Future AI Magic Limited, you accept and agree to be bound by the following terms and conditions. If you do not agree to this Agreement, please do not access or use our services.

Certain features of Future AI Magic Limited (hereinafter referred to as "we" or "our")'s services may be subject to additional guidelines, terms or rules, which will be posted in conjunction with such features. We reserve the right to modify, suspend or terminate these services (or any part thereof) at any time.

1. Eligibility

You must be at least 13 years old to access or use our services. If you are under the age of 18 (or the legal age of majority where you live), you may only access or use our services under the supervision of a parent or legal guardian who agrees to be bound by this Agreement. If you are the parent or legal guardian of a user under the age of 18 (or the legal age of majority), you agree to be fully responsible for the user's actions or omissions in connection with our services. If you access or use our Services on behalf of another person or entity, you represent that you have the authority to accept this Agreement on that person or entity's behalf and that that person or entity agrees to be responsible to us if you or another person or entity violates this Agreement.

2. Premium Subscription

By signing up for a subscription, you hereby agree to these payment terms and conditions. If you choose to subscribe to Professional Services, you will sign up for an auto-renewing subscription that requires periodic payments and agree to pay the then-applicable Professional Services fees listed in the Agreement. You will pay for your subscription via credit card, Google Play or similar app store intermediary providers. You will be charged weekly or annually from the date you first subscribe to Premium Services and will be automatically charged weekly or annually thereafter unless you cancel your subscription.

3. Privacy

Please refer to our Privacy Policy for how we collect, use and disclose your information.

4. Use of our Services

As long as you comply with these terms, you may use our Services for personal and non-commercial purposes.

Mobile Applications. When you download our software applications from Google Play or other application distribution platforms ("App Stores"), you acknowledge and agree that:

• These Terms are between us, not with the App Stores. We, not the App Stores, are responsible for our software applications.

• The App Stores have no obligation to provide any maintenance and support services for our software applications, or to address any warranty claims.

• The App Stores are not responsible for addressing any claims you may have in connection with our software applications, such as product liability claims, consumer protection claims, intellectual property infringement claims, or any claims that our software programs fail to conform to any applicable legal or regulatory requirements.

• The App Stores are third-party beneficiaries of these Terms and have the right to enforce these Terms against you (as it relates to your licensing of our software applications through their App Stores).

• When using our software applications, you must also comply with the App Stores' Terms of Service.

5. User Content

Our Services may allow you to upload images and generate content based on images. Subject to this Agreement and the Privacy Policy, Future AI Magic Limited does not claim ownership of any user content you post on or through the Services and is only used to provide you with the Services.

You acknowledge that some Services are supported by advertising revenue and may display advertisements and promotions, and you hereby consent that Future AI Magic Limited may place such advertisements and promotions on the Services or on or in connection with your User Content or with your User Properties. The manner, mode, and extent of such advertising and promotions may change without notice to you. You acknowledge that we may not always identify paid Services, sponsored content, or commercial communications.

Finally, you acknowledge that all intellectual property rights in our Services, including the underlying software and technology and the information and content provided in our Services, belong to us and our suppliers (including other users) and are protected by copyright laws around the world. We and our suppliers (including other users) reserve all rights not granted in these Terms. We may use any suggestions, ideas, feedback, or comments you provide to us regarding our Services for any purpose without any obligation to you.

6. Prohibited Conduct and Content

You will not violate any applicable laws, contracts, intellectual property rights or other third-party rights or infringe, and you will be solely responsible for your conduct when accessing or using our Services. You will not:

Engage in any harassment, threats, intimidation, robbery or stalking;

Use or attempt to use a user's account without authorization from other users and Future AI Magic Limited;

Use our Services in any way that could disrupt, interfere, negatively impact or inhibit other users from fully enjoying our Services, or in any way damage, disable, overburden or impair the functionality of our Services;

Reverse engineer any aspect of our Services, or do anything that might discover the source code, or bypass or circumvent measures that prevent or restrict access to any part of our Services;

Attempt to bypass any content filtering technology we use, or attempt to access any unauthorized access features or areas of our Services;

Develop or use any third-party applications that interact with our Services, including any scripts designed to extract data from our Services, without our prior written consent;

Use our Services for any illegal or unauthorized purpose, or engage in, encourage or promote any activity that violates this Agreement.

You may only post or otherwise share non-confidential User Content, and you have all necessary disclosure rights. You may not create, post, store or share any User Content that:

is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory or fraudulent;

constitutes, encourages or provides instructions for a criminal offense, violates the rights of any party, or otherwise creates liability, or violates any local, state, national or international law;

may infringe any patent, trademark, trade secret, copyright or other intellectual property or proprietary right of any party;

contains or depicts any statements, comments or claims that do not reflect your actual views and experiences;

impersonates or misrepresents your affiliation with any person or entity;

contains any unsolicited promotion, political campaign, advertising or solicitation;

includes any private or personal information of a third party without their consent;

contains any viruses, corrupted data or other harmful, disruptive or destructive files or content; or

is, in our sole discretion, offensive, or restricts or inhibits any other person from using or enjoying our Services, or may cause harm or liability of any kind to Future AI Magic Limited or others. In addition, although we have no obligation to filter, edit or monitor User Content, we may remove or delete User Content at any time and for any reason.

7. Copyright Owners

It is our policy to remove or disable access to materials that infringe copyrights on our Services upon notice from the copyright owner or the copyright owner's legal representative. If you believe that your work has been copied and posted through our Services in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information:

• An electronic or physical signature of the person authorized to act on behalf of the copyright owner;

• Identification of the copyrighted work that you claim has been infringed;

• The location of the material that you claim is infringing on our Services;

• Your contact information;

• Your written statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

• A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

8. Other Services

Our Services may contain links to content, products or services provided by other people and businesses. These content, products and services are not under our control. We are not responsible for their content, services, performance, operations, availability, business practices or policies (including their privacy and data collection practices). We provide these products and services only as a convenience, but we do not imply any endorsement or recommendation of their products or services, nor do we imply any association with them. Access or use of their products and services shall be at your own risk, and any costs or obligations arising from the processing of such products and services shall also be borne by you.

We do not control, endorse or be responsible for any User Content or Third-Party Content provided or linked on our Services.

Your use of our Services is at your own risk. Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. In addition, Future AI Magic Limited does not represent or warrant that our Services are accurate, complete, reliable, current or error-free. Although Future AI Magic Limited attempts to make your access and use of our Services safe, we cannot and do not guarantee that our Services or servers are free of viruses or other harmful components. You bear all risks as to the quality and performance of the Services.
